Romanian Justice minister ignores negative notice of the Supreme Council of Magistrates (CSM) and announces he will not change bills on the judiciary
The draft amendment of the Law on Justice will not be adjusted despite the negative notice of the Supreme Council Of Magistrates (CSM),stated yesterday in Iasi, Justice Minister Tudorel Toader, reports Agerpres. Minister Toader said there was no question of rewriting the draft laws of justice.
„There is nothing to rewrite there, there are only a few solutions, points on which there are different opinions. Otherwise there is convergence. I expected to receive punctual notices from the Supreme Council of Magistrates (CSM) on each legislative proposal, not one in bulk ,but it is their option, we are referring to the legislative technique, the Constitution, and the bill will follow its course, with some changes,” he said.
Tudorel Toader made these statements in Iasi, at the opening ceremony of the 2017-2018 academic year at „Alexandru Ioan Cuza” University.
Regarding the negative notice given by the magistrates of the Supreme Council of Magistrates (CSM), the Minister of Justice said that he had reservations about this notice even if it was an advisory one.
„I have some reservations about this negative notice, be it an advisory one, because in the draft law, the Ministry of Justice has retained many of the proposals made by the Supreme Council Of Magistrates itself, most of the proposals came from there. I understand,therefore, that the Supreme Council of Magistrates (CSM) gave a negative notice on the solutions proposed by them. The draft law proposes amendments to the agreement of the laws of justice with the decisions of the Constitutional Court. You can not give a negative notice, you can not say that you do not agree with a change that transposes the decisions of the Constitutional Court,” Minister Toader said.
Tudorel Toader also said that „it is true that the bill proposes to amend many legislative solutions that I have appreciated, but the Parliament will decide if there are certain privileges.”
