Telephony operators, forced to inform authorities on call data

The electronic telecomm companies are obligated to stock, for six months, certain data regarding phone calls, written messages and e-mails, generated or transmitted via the operator’s services. The data can be accessed by the Prosecution Offices, the Interior Ministry Information Service, the Romanian intelligence Service and the Foreign Intelligence Service, on their demand. The services may demand such info only after the début of the criminal prosecution against persons, with the approval of the Court or at he prosecutors’ demand.

The data can be used by the above-mentioned institutions for the research, discovery and surveillance of serious crimes.

The data will be electronically stored in a database, created and managed by the wired and mobile telephony operators, the latest law in the telecomm rules. The cost for the implementation of the law will be tax deductible.

Operators will also stock the necessary data for the identifying the source and the destination of the call / message / e-mail, the telecomm terminal used for the communication, the call location, the date, time and duration of the call.

Any accessing of the data and any data transfer without proper authorization will be considered as crime and sentenced to 1 to 5 years in jail.
